“The court correctly found no safety risk from any Amos Miller food, and expressly recognized the sincere testimony of Amos Miller’s food consumers of the real benefits of his food. The court correctly pulled back on the scope of the injunction so that it only prohibits marketing and sale of raw milk products and exempts family and noncommercial use. The court accepts the need people have for Amos Miller’s products, but claims the legislature must fix that need. While we welcome the call for legislative remedy, we will appeal the order and the members will be filing a civil rights suit against Secretary Redding for violating their Constitutional rights. Secretary Redding has annoited himself the Pope of food for the entire country: if he doesn’t bless your food, you’re not allowed to eat it or even possess it. Would anyone in their right mind choose PDA plane food over Amos Miller Amish farmed food? PDA does not have the legal authority to govern the choices of people in Minnesota, North Carolina, Tennessee and every other state of the union outside Pennsylvania. This case will define the future of food freedom in America, and it has only just begun.”

Key Highlights of the Ruling

The ruling allows Amos Miller to sell all of his products to his Private Membership Association (PMA) with the exception of the raw milk, pulling back the previous injunction preventing all sales. Judge Thomas Sponaugle has extended an invitation to Miller to become Pennsylvania’s 115th licensed raw milk dairy. However that permit would not allow Amos Miller to make almost all raw milk products, including butter, ice cream, soft cheeses, cream, and kefir. Under the permit Miller would only be able to sell milk, yogurt, and hard cheese aged for 60+ days.

After dismissing the public, Judge Sponaugle asked the Pennsylvania Department of Agriculture (PDA) if Miller could obtain a permit for the raw milk, yogurt, and hard cheeses and continue to sell the other products without permit. The PDA Attorney responded “No. With a raw dairy permit Miller would not be allowed to sell anything beside raw whole milk, yogurt, and hard cheese.”

The next day the judgement to uphold the raw milk injunction was released. Amos Miller’s attorney Robert Barnes is filing an appeal.
